Kullanım Şartları

Bu şartlar, şirketlerin ve yetkili kullanıcıların Shifter ile çalışma alanı oluşturma, ekip yönetme, vardiya planlama, izin takibi, otomasyon kullanımı, rapor inceleme ve abonelik yönetimi yaparken uyması gereken kuralları açıklar.
1. Kabul ve çalışma alanı yetkisi
Bir Shifter hesabı oluşturarak, oturum açarak, bu şartları kabul ederek veya hizmeti bir şirket adına kullanarak bu Kullanım Şartlarını kabul eder ve ilgili şirket çalışma alanını bağlama yetkiniz olduğunu onaylarsınız.
Shifter içine ekip üyeleri, yöneticiler veya çalışanlar eklerseniz, erişimlerinin görevlerine uygun olduğundan ve kuruluşunuzun çalışma bilgilerini girmek ve yönetmek için hukuka uygun dayanağı bulunduğundan siz sorumlusunuz.
2. Hizmetin amacı
Shifter, operasyon ekipleri için geliştirilmiş bir iş gücü vardiya planlama platformudur. Şirket çalışma alanı oluşturmayı, lokasyon ve departman tanımlamayı, çalışan profilleri ve atamalarını yönetmeyi, vardiya ve izin planlamayı, takvim üretmeyi, bekleyen vardiya işlemlerini takip etmeyi ve operasyonel raporları incelemeyi destekler.
Hizmet, iş amaçlı iş gücü planlaması için tasarlanmıştır. Bordro, hukuki danışmanlık, iş hukuku uyumluluğu, vergi, muhasebe, tıbbi kayıt, acil durum yönlendirme veya çalışan gözetim sistemi değildir; oluşturduğunuz takvim ve raporlardan alınan kararlardan kuruluşunuz sorumludur.
3. Hesaplar, güvenlik ve kabul edilebilir kullanım
Doğru kayıt bilgileri sağlamalı, kimlik bilgilerinizi güvende tutmalı ve hesap, şirket, dil, saat dilimi, faturalama ve çalışan yönetimi bilgileri değiştiğinde bunları zamanında güncellemelisiniz.
Yetkisiz erişim denemek, hizmetin işleyişine müdahale etmek, zararlı içerik yüklemek, plan limitlerini aşmaya çalışmak, hizmeti kazımak, işyeri mevzuatını ihlal edecek şekilde kullanmak veya kuruluşunuzca yetkilendirilmemiş kişilere erişim vermek yasaktır.
4. Müşteri verileri ve çalışan bilgileri
Kuruluşunuz Shifter içine gönderdiği şirket, çalışan, vardiya, izin, lokasyon, departman, pozisyon, tercih, atama ve faturalama bilgilerini kontrol eder. Shifter bu bilgileri hizmeti sunmak, güvenceye almak, desteklemek ve iyileştirmek için işler.
Girdiğiniz iş gücü verilerinin doğruluğundan ve hukuka uygunluğundan, iç politikalarınız veya geçerli hukuk kapsamında gerekli bildirim, izin ya da çalışan iletişimlerini sağlamaktan siz sorumlusunuz.
5. Vardiya otomasyonu ve kullanıcı incelemesi
Shifter, yapılandırdığınız vardiyalar, uygunluk bilgileri, döngü şablonları, departmanlar, çalışan rolleri, izin türleri ve kullanım limitleri gibi verilere dayanarak otomatik vardiya planlama, kota kontrolü, kural bazlı atama ve raporlama özellikleri sunabilir.
Otomatik çıktılar planlama yardımcısıdır. Kuruluşunuz oluşturulan vardiyaları incelemeli, bekleyen vardiyaları onaylamalı veya revize etmeli, personel kararlarını doğrulamalı ve nihai planların operasyonel, sözleşmesel ve hukuki gereksinimlere uygun olmasını sağlamalıdır.
6. Planlar, faturalama ve ödemeler
Bazı Shifter özellikleri, uygulamada kullanım anında gösterilen plan limitleri, abonelik durumu, çalışan sayısı, fatura dönemi, para birimi, yenileme, iptal ve ödeme yöntemi kurallarına tabidir.
Ödemeler üçüncü taraf ödeme sağlayıcıları tarafından işlenebilir. Shifter, faturalamayı yürütmek için gerekli fatura, abonelik, işlem ve ödeme yöntemi referans verilerini saklayabilir; hassas kart veya ödeme bilgileri ise ödeme sağlayıcının kendi şartları kapsamında işlenebilir.
7. Erişilebilirlik, değişiklikler ve destek
Shifter hizmetini güvenilir tutmak için çalışırız; ancak bakım, güncellemeler, üçüncü taraf hizmetleri, ağ sorunları, güvenlik olayları veya kontrolümüz dışındaki durumlar nedeniyle kesintiler yaşanabilir.
Ürünü iyileştirmek, kullanıcıları korumak, hukuki gereklilikleri karşılamak veya hizmeti işletmek için özellikleri güncelleyebilir, ekleyebilir, sınırlandırabilir, askıya alabilir veya sonlandırabiliriz. Önemli değişiklikler uygulamaya veya bu şartlara yansıtılır.
8. Askıya alma, sonlandırma ve sorumluluk
Shifter kullanmayı bırakabilir veya çalışma alanınız için sunulan seçeneklere göre hesap kapatma talebinde bulunabilirsiniz. Güvenlik, ödeme yapılmaması, hukuki uyumluluk veya bu şartların ihlali durumunda erişimi askıya alabilir veya sonlandırabiliriz.
Kanunun izin verdiği en geniş ölçüde Shifter, her vardiya, rapor veya önerinin hatasız olacağı ya da her iş gereksinimine uyacağı garantisi olmadan operasyonel planlama amacıyla sunulur. Her taraf kendi uyumluluk yükümlülüklerinden sorumludur.
9. Mobil mağaza koşulları (Apple ve Google)
Shifter mobil uygulamasını Apple App Store veya Google Play üzerinden edindiyseniz, uygulamayı yalnızca bir Apple markalı ürün veya Google Play'i destekleyen bir cihazda, ilgili mağazanın kullanım kurallarına uygun şekilde kullanabilirsiniz. Apple Inc. bu Kullanım Şartları'nın bir tarafı değildir ancak üçüncü taraf lehtar olarak bu şartları size karşı uygulama hakkına sahiptir; uygulamanın bakım ve destek yükümlülüğü Apple'a değil, Shifter'a aittir.
Uygulama içi abonelikler ilgili mağaza hesabınız üzerinden faturalandırılır, fiyatlar mağazada gösterildiği şekilde uygulanır ve mevcut dönem sona ermeden en az 24 saat önce iptal edilmediği sürece otomatik olarak yenilenir. Aboneliğinizi yönetmek veya iptal etmek için App Store/Google Play hesap ayarlarınızı kullanmalısınız; Shifter mağaza üzerinden yapılan ödemeleri doğrudan iade edemez, iade talepleri ilgili mağazanın politikasına tabidir.

These terms explain how companies and authorized users may use Shifter to create workspaces, manage teams, plan shifts, track leave, use automation, review reports, and manage subscriptions.
1. Acceptance and workspace authority
By creating a Shifter account, signing in, accepting these terms, or using the service on behalf of a company, you agree to these Terms of Use and confirm that you are authorized to bind that company workspace.
If you add team members, managers, or employees to Shifter, you are responsible for making sure their access is appropriate for their role and that your organization has a lawful basis to enter and manage their work information.
2. Service purpose
Shifter is a workforce scheduling platform for operations teams. It helps create company workspaces, define locations and departments, manage employee profiles and assignments, plan shifts and leave, generate schedules, track pending schedule actions, and review operational reports.
The service is intended for business workforce planning. It is not a payroll, legal, labor-law compliance, tax, accounting, medical, emergency dispatch, or employee surveillance system, and you remain responsible for decisions made from the schedules and reports you create.
3. Accounts, security, and acceptable use
You must provide accurate registration information, keep credentials secure, and promptly update account, company, locale, timezone, billing, and employee administration information when it changes.
You may not misuse Shifter by attempting unauthorized access, interfering with service operation, uploading malicious content, bypassing plan limits, scraping the service, using it to violate workplace laws, or granting access to people who are not authorized by your organization.
4. Customer data and employee information
Your organization controls the company, employee, schedule, leave, location, department, job title, preference, assignment, and billing information it submits to Shifter. Shifter processes that information to provide, secure, support, and improve the service.
You are responsible for the accuracy and legality of the workforce data you enter, including obtaining any notices, permissions, or employee communications required by your internal policies or applicable law.
5. Scheduling automation and user review
Shifter may provide automated scheduling, quota checks, rule-based assignment, and reporting features based on data you configure, such as shifts, availability, cycle templates, departments, employee roles, leave types, and usage limits.
Automated outputs are planning aids. Your organization must review generated schedules, approve or revise pending schedules, confirm staffing decisions, and ensure final plans match operational, contractual, and legal requirements.
6. Plans, billing, and payments
Some Shifter features are subject to plan limits, subscription status, employee counts, billing interval, currency, renewal, cancellation, and payment-method rules shown in the application at the time you use them.
Payments may be processed by third-party payment providers. Shifter may store invoice, subscription, transaction, and payment-method reference data needed to operate billing, but the payment provider may handle sensitive card or payment credentials under its own terms.
7. Availability, changes, and support
We work to keep Shifter reliable, but the service may be interrupted by maintenance, updates, third-party services, network issues, security events, or circumstances outside our control.
We may update, add, limit, suspend, or discontinue features when needed to improve the product, protect users, meet legal requirements, or operate the service. Material changes will be reflected in the application or these terms.
8. Suspension, termination, and responsibility
You may stop using Shifter or request account closure according to the options available for your workspace. We may suspend or terminate access if required for security, non-payment, legal compliance, or violation of these terms.
To the maximum extent permitted by law, Shifter is provided for operational planning without warranties that every schedule, report, or recommendation will be error-free or fit every business requirement. Each party remains responsible for its own compliance obligations.
9. Mobile app store terms (Apple & Google)
If you obtained the Shifter mobile app through the Apple App Store or Google Play, you may only use it on an Apple-branded product or a device that supports Google Play, in accordance with that store's usage rules. Apple Inc. is not a party to these Terms of Use but is a third-party beneficiary entitled to enforce them against you; maintenance and support for the app remain Shifter's responsibility, not Apple's.
In-app subscriptions are billed through your store account, priced as shown in the store, and renew automatically unless canceled at least 24 hours before the end of the current period. Manage or cancel your subscription through your App Store/Google Play account settings; Shifter cannot directly refund store purchases — refund requests are subject to that store's own policy.
